在地產大亨川普(Donald Trump)可望篤定獲得共和黨提名角逐白宮大位之際，部份保守派人士呼籲參議員就大法官提名人賈蘭德(Merrick Garland)的人事案，進行表決。對此，參議院多數黨(共和黨)領袖麥康奈(Mitch McConnell)4日不改立場，仍堅持在歐巴馬總統明年卸任前，不會就此人事案舉行聽證會和表決。
麥康奈的發言人波普(David Popp)告訴路透社，「參院領袖對賈蘭德的立場沒有改變。」
美國最高法院大法官史卡利亞(Antonin Scalia)2月驟逝，歐巴馬總統依法在3月提出中間派法官賈蘭德為繼任人選，並要求國會就此進行聽證和表決。但共和黨人主張，即將於明年1月卸任的歐巴馬，應把提名權留給下任總統。
部份保守派人士主張，在川普可望獲得共和黨提名的情況下，參議院應就賈蘭德的任命案進行表決。他們擔心，可望代表民主黨出馬的前國務卿希拉蕊(Hillary Clinton)有可能在總統大選中打敗川普。在希拉蕊就任總統後，將會提名更自由派的法官出任終身職的大法官。
不過參議院共和黨籍的司法委員會主席葛拉斯里(Chuck Grassley)，立場和麥康奈一樣強硬，也拒絕就賈蘭德的提名案舉行聽證會。
